Privacy Policy

This Privacy Policy describes how CUBO Beverages Inc. ("CUBO," "we," "us," or "our") collects, uses, and shares personal information when you visit or make a purchase through cubopods.com (the "Site"). It does not cover data collected from CUBO Equipment after purchase, which is addressed separately in Section 8 of our Terms of Sale ("Equipment Data").

1.Information We Collect

2.How We Use It

To process and fulfill machine and CUBO Pod orders, including shipping and payment;
To respond to customer service, warranty, and sales inquiries;
To send order confirmations and service updates (these are not optional, as they're necessary to fulfill your order);
To send marketing emails or texts if you've opted in — you can opt out at any time via the unsubscribe link or by contacting us;
To show you relevant ads on other platforms (such as Meta or Google) and measure their performance, if you have not opted out as described in Section 6;
To understand how the Site is used, so we can improve it;
To detect and prevent fraud and protect the security of the Site;
To comply with legal obligations.

We don't sell your personal information for money. We do use advertising pixels that share certain Site usage data (such as pages viewed and device identifiers) with advertising platforms like Meta and Google so we can show you relevant ads and measure their effectiveness. Under California and some other state privacy laws, this counts as "sharing" for cross-context behavioral advertising, and you can opt out — see Section 6.

We also share information with:

Service providers who help us run the business — for example, Shopify (checkout and order management), our payment processor, our fulfillment and shipping partners, and Klaviyo (email/SMS marketing);
Advertising partners, such as Meta and Google, as described above;
Professional advisors, such as our accountants or lawyers, where necessary;
Authorities, where required to comply with the law, protect our rights, or respond to a valid legal request;
A buyer or successor, in the event of a merger, acquisition, or sale of some or all of CUBO's assets.

4.Cookies & Advertising Technologies

The Site uses cookies and similar technologies, including advertising pixels, to keep the shopping cart working, remember your preferences, understand aggregate site traffic, and show you relevant ads on other platforms. You can control cookies through your browser settings, and where applicable through our cookie preference tool; disabling cookies may affect parts of the Site, such as checkout. For visitors in the EU/UK, non-essential cookies (including advertising pixels) are only set with your consent, requested via our cookie banner.

5.Data Retention & Security

We keep personal information for as long as needed to fulfill the purposes described above, including to maintain order records for accounting and warranty purposes, or as required by law. We use reasonable administrative and technical safeguards to protect your information, but no method of transmission or storage is completely secure.

6.Your Rights & Choices

California residents (CCPA/CPRA): you have the right to know what personal information we collect, to request deletion or correction of your information, and to opt out of the "sharing" of your information for cross-context behavioral advertising described in Section 3. To opt out, click "Do Not Sell or Share My Personal Information" in the Site footer, or contact us as described below; we also honor Global Privacy Control (GPC) browser signals. We will not discriminate against you for exercising these rights.

Other US residents: depending on your state, you may have similar rights to access, correct, delete, or opt out of certain uses of your information.

EU/UK visitors: CUBO does not market or sell products to customers in the EU/UK through this Site, but if you browse the Site from the EU/UK, we rely on your consent (for cookies/advertising, via our cookie banner) or our legitimate interests (for core Site functionality) as the legal basis for processing your information. You have the right to access, correct, delete, or restrict use of your information, to object to processing, to receive a portable copy of your data, and to lodge a complaint with your local data protection authority.

To exercise any of these rights, email cubocare@cubopods.com with the subject line "Privacy Request." We may need to verify your identity before completing certain requests.

7.Children's Privacy

The Services are directed at commercial food-service operators and are not intended for, or directed at, children. We do not knowingly collect personal information from anyone under 13.

8.Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected in the "Last updated" date above; we encourage you to review this page periodically.
